EU Announces Anti Evasion Investigation Results on Stainless Steel Pipe Butt Weldments Imported from Malaysia
On March 2, 2023, the European Commission's Implementing Regulation No. 2023/453 extended the final Anti-Dumping Duty imposed by Implementing Regulation No. 2017/141 on the import of certain stainless steel pipes and pipe butt welding fittings (whether completed or not) originating in China to the import of certain stainless steel pipes or pipe butt welding fittings consigned from Malaysia, whether completed or not, whether declared to be originating in Malaysia or not.
In January 2017, according to Commission Implementing Regulation (EU) 2017/141, the European Commission imposed final Anti-Dumping Duty on the import of certain stainless steel pipes and pipe butt welding fittings originating in China and Taiwan, China, which was revised by Commission Implementing Regulation (EU) 2017/659. The current Anti-Dumping Duty on imported products originating in China is 30.7% to 64.9%, and that on imported products originating in Taiwan, China is 5.1% to 12.1%.
In January 2022, the European Commission initiated an expiration review of existing measures in accordance with Article 11 of the Basic Regulations by issuing a notice in the Official Journal of the European Union. This review is still ongoing.
The investigation concluded that, according to the Implementation Regulations (EU) 2017/141, the final Anti-Dumping Duty imposed on imported products of certain stainless steel pipes or pipe fittings (whether finished or not) originating in China was evaded through Malaysia.
The final Anti-Dumping Duty levied by the Implementation Regulation (EU) 2017/141, revised by the Implementation Regulation (EU) 2017/659, on the import of certain stainless steel pipe butt welding fittings (whether finished or not) originating in China, is hereby extended to the import of austenitic stainless steel pipes and pipe butt welding fittings consigned from Malaysia, corresponding to AISI types 304304L, 316316L, 316Ti, 321 and 321H and equivalent products in other specifications, The maximum outer diameter does not exceed 406.4 millimeters, the wall thickness is 16 millimeters or less, the average roughness (Ra) of the inner surface is not less than 0.8 micrometers, without flanges, whether or not completed, currently classified as CN codes EX 7307 23 10 and EX 7307 23 90, whether or not declared to be originating in Malaysia (TARIC code 730723104073072390357307239040).
Pantech Stainless And Alloy Industries Sdn. Bhd and SPI United Sdn. Bhd, two companies cooperating with the European Commission, will be exempted. The extended tariff is 64.9% of the Anti-Dumping Duty applicable to "all other companies" in China.
This regulation shall come into effect on March 3, 2023.
